Doyle Dennis Avery LLP Files Suit Against Union Pacific for Failure to Maintain a Locomotive
On or about October 27, 2023, in the Parish of East Baton Rouge, Doyle Dennis Avery LLP’s client was working in Union Pacific’s Livonia yard on a locomotive that pulled into the yard; as the client went down the engine ladder, the client slipped from a rung and fell due to the ladder’s alleged poor condition. As a result of the fall, the client struck his head and the entire left side of his body. The impact caused the client to lose consciousness and caused debilitating injuries to the head, neck, left arm, back, and body. Due to the nature and severity of the injuries, an ambulance brought the client to an emergency room via ambulance, where the client was treated and given medication.
Doyle Dennis Avery LLP’s client is a hardworking citizen and loyal conductor for Union Pacific. They were, specifically, operating as a conductor for twenty-eight years. Doyle Dennis Avery LLP filed this action due to Union Pacific’s negligence under FELA and Violation of Federal Safety Statutes and Regulations. FELA is designed to protect the rights of railroad employees injured, sickened or killed in the course of their employment. Through Union Pacific, the alleged failure to provide the client with a reasonably safe place to work violates FELA, which allegedly caused the client’s injuries. Such alleged violations were the legal cause of the client’s injuries and damages. However, these alleged violations of these regulations, either in whole or in part, caused the incident and the injuries and damages suffered by the client and made the basis of this action.
The client’s damages include past and future physical and mental pain and suffering, and physical disability and disfigurement, which will impact the client’s ability to work to earn wages and pay for past and future medical expenses which allegedly resulted from Union Pacific’s FELA Negligence and violation of Federal safety statutes and regulations that caused the client’s injuries and damages.
