On or about October 10, 2021 at approximately 3:40 p.m., the client was working as a conductor for Union Pacific on Union Pacific’s train. At the exact same time, John Chop Trucking’s 18-wheeler vehicle collided with Union Pacific’s train. The client attempted to stop the train but was unable to. Upon the collision, the client’s engineer seat failed to lock in the forward position. As a result of the collision caused by John Chop Trucking and Union Pacific’s defective seat, the client sustained serious injuries to his neck, upper back, and right shoulder.
