The Youngdahl, Law Firm, P.C. and Doyle Dennis Avery LLP have recently filed a lawsuit charging the Union Pacific Railroad Company with negligence in failing meet rules and obligations to an employee which resulted in an unfortunate and avoidable accident to them. The employee, or client, was under employment as a conductor while injured during the operations of his job.
The client, in their normal duties around March 6, 2020, was lining a railroad switch when the defective switch suddenly hung up and caused him to sustain injuries to his back, neck, left shoulder, right groin, and other parts of his body. The client was working at the time for his employer, Union Pacific, in furthering their interstate commerce activities. The employer failed to meet its non-delegable duty to provide a reasonably safe place to work. This entitles the client to compensation due to the FELA and general negligence of Union Pacific. Additionally, the client will seek further damages and compensation for medical expenses, lost wages, and other impacted areas.
