Doyle Dennis Avery LLP Files Suit Against Martin Marietta Materials, Inc. and Union Pacific

On behalf of their client, Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C, have jointly filed suit against Martin Marietta Materials, Inc., Martin Marietta Materials Southwest, LLC, and Union Pacific Railroad Company. Their client was employed and working for Union Pacific as a conductor at the time of the incident.
The client, or Union Pacific’s employee, on or about July 10, 2020, was riding on the ladder of a railcar facilitating a shoving move, in the course and scope of his employment. Suddenly and unexpectedly a Martin Marietta and/or Martin Marietta SW employee backed his front-end loader into the client. The ensuing collision crushed the client’s left foot, severing two of his toes; injured his shoulder; and caused bruising and scraping to multiple parts of his body. Ultimately, Martin Marietta and Union Pacific owed the client numerous protections which should have prevented the unfortunate incident. Martin Marietta and Union Pacific failed their legal obligation to the client and showed negligence in their actions causing the incident. Both companies and their employees had a non-delegable duty to follow Federal Railroad Safety Statutes and Regulations, which they failed to and were the legal cause of the incident, the injuries, and the damages sustained by the client. As a result, Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C, will pursue justice for their client and seek the damages he is owed under federal laws such as FELA, SAA, and LIA.
