Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. vs. BNSF
Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. have filed suit in Nolan County Texas on behalf of our client who sustained serious injuries while employed with BNSF. BNSF is a foreign corporation doing business in the State of Texas and all or a substantial part of the events or omissions giving rise to the claim occurred in Nolan County. This lawsuit arises under the Federal Employers’ Liability Act (“FELA”) (45 U.S.C. § 51 et seq.), the Locomotive Inspection Act (“LIA”) (49 U.S.C. § 20701), and associated Federal Railroad Administration regulations, and railroad industry standards for personal injuries sustained by our client while employed by BNSF and while engaged in interstate commerce.
At the time of the incident, BNSF was a common carrier by railroad engaged in interstate commerce, and our client was employed by BNSF in furtherance of those activities. On or about May 19, 2022, while in the course and scope of their employment, our client reported the locomotive they were working on had a defective air conditioner. The client repeatedly requested another engine due to it being over 100 degrees outside. BNSF failed to remedy the situation and left our client to suffer the effects of the extreme heat inside the railcar. As a result, our client suffered a heat stroke while continuing to work in extreme conditions. Specifically, our client collapsed, struck their head, and lost consciousness. An ambulance was eventually called for our client to be transported to a regional medical center where they recuperated from the work-related incident and injuries suffered to their head and legs. As a result of this incident Doyle Dennis Avery LLP and The Youngdahl Law Firm, P. C. have been retained to aid their client in the pursuit of justice for their employer BNSF’s negligence.
Before the incident, Doyle Dennis Avery LLP’s client served for ten years for BNSF as a hardworking and loyal conductor and engineer. The client at the time of their injuries was an able-bodied railroad worker that was owed a reasonably safe place to work under provisions of FELA and the LIA. BNSF negligently failed this obligation and many others by and through its employees, agents, and servants. BNSF failed to exercise due care and caution commensurate with the surrounding circumstances and our client suffered severe and debilitating injuries to his head and legs as a result. Damages include but are not limited to: physical pain and suffering in the past and future; mental anguish in the past and future; lost earnings and benefits in the past; loss of future wage-earning capacity; physical impairment or disability in the past and future; medical expenses in the past and future; disfigurement in the past and future; and loss of enjoyment of life in the past and future.
