Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. File Suit on behalf of Locomotive Engineer
Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. recently filed a FELA lawsuit in Harris County, Texas, on behalf of their client against their employer Union Pacific, and defendants Pinnergy Ltd and its employee Ladonta Sweatt. This lawsuit has been initiated to recover damages that our joint client has sustained and will sustain as a result of the wrongful conduct of Defendants that resulted in a collision between a Pinnergy tanker-trailer truck and Union Pacific locomotive.
On or about November 22, 2021, Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C.’s client was onboard a locomotive operating in the course and scope of their employment as an engineer for Union Pacific. Defendant Sweatt, employed by Pinnergy and in a truck owned by Pinnergy, at or near Red River Parish, Louisiana negligently pulled the tanker-trailer truck onto the railroad crossing and into the path of our client’s train. As a result of the collision, the client suffered injuries to their back, spine, and other parts of their body.
Defendants Sweatt and Pinnergy through its owners, employees, representatives, and/or agents committed negligent acts and/or omissions that were the proximate cause of the collision and injuries to the client of Doyle Dennis Avery LLP and The Youngdahl Law firm, P.C. Union Pacific Railroad Company as a FELA employer breached their duty to provide a reasonably place to work to the client of Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. Additionally, all the defendants failed numerous obligations and protections owed to a FELA railroader such as our client. For these reasons, among others outlined in the lawsuit, are the basis of this lawsuit and injuries sustained by our FELA client.
Prior to the collision, Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C.’s client was a hardworking, loyal and healthy engineer for Union Pacific. As a result of the collision the client suffered physical pain and suffering, mental anguish, and in all reasonable probability will continue to suffer in this manner for the balance of their life. Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. will now fight on behalf of our client to recover damages including, but not limited to: physical pain and mental anguish in the past and future; lost earnings and benefits in the past; loss of future wage-earning capacity and benefits in the future; and loss of enjoyment of life in the past and future. Additionally, our client is seeking punitive damages against Pinnergy LTD and Sweatt, who through the acts and omissions of their owners, employees, and/or agents were grossly negligent and/or malicious in that its/their conduct was the product of a conscious disregard for the health and safety of the client of Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. and others similarly situated.
