In Harris County, Texas, Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. recently filed a FELA lawsuit on behalf of their client against GENCO TRANSPORT LLC and Dewayne Thomas, an employee of the company. The purpose of this lawsuit is to seek compensation for losses that our joint client has already suffered and will continue to suffer as a result of the defendants’ illegal actions that led to a collision between a Kansas City Southern Railway Company locomotive and an 18-wheeler truck owned by GENCO.
The client of Doyle Dennis Avery LLP and The Youngdahl Law Firm, P.C. was on a locomotive operating in the course and scope of their work as an engineer for Kansas City Southern Railway Company on or about July 29, 2022. At or near Shreveport, Louisiana, defendant Thomas, a GENCO employee driving a GENCO-owned truck, carelessly backed the 18-wheeler truck across the railroad crossing and directly in front of our client’s train. The client sustained injuries to their left hand as well as other parts of their body as a result of the collision.
The collision and the client’s injuries were caused by the defendants Thomas and GENCO’s negligent acts and/or omissions, which were carried out by their respective owners, employees, representatives, and/or agents. All of the defendants also fell short of a number of responsibilities and safeguards owed to a FELA railroader like our client. The defendants’ failure to drive safely and reasonably under the circumstances, to pull their 18-wheeler off the tracks to make room for the approaching train, and their failure to stop completely at the stop sign posted at the crossing are just a few examples of their negligence. These factors—among others listed in the litigation precisely led to this case and the damage that our FELA client experienced.
